Privacy Policy

Last updated: August 2026

Fairly, LLC is the business responsible for the personal information described here - the "controller," in the language most privacy laws use. This policy covers the Fairly customer app, the Fairly Driver app, and the Fairly restaurant portal (together, "Fairly"). It describes what information we collect, why, and how it's used.

Information we collect

How we use this information

Solely to operate the marketplace: process and fulfill orders, calculate and pay out delivery fees, verify driver applications, respond to support requests, and send order-status notifications. We do not sell your information to third parties or use it for advertising.

Who we share it with

We don't share your information with anyone else, and we don't sell it.

Data retention

Order and account records are kept for as long as your account is active, plus a reasonable period afterward for financial recordkeeping (tax, dispute, and refund purposes). Driver application photos are kept only as long as needed to review the application and maintain driver eligibility records.

SMS messaging

If you provide a phone number at checkout, we send one transactional SMS confirming your order number once the order is placed - no marketing texts. Message and data rates may apply. Reply STOP to any Fairly text to opt out, or HELP for support. See the Terms of Service for the full SMS program terms.

Your choices

You can order as a guest without creating an account. Location permission for the customer app is optional and can be denied or revoked in your device settings at any time; it only affects address autocomplete convenience.

Delete your account or data

Any Fairly user — customer, driver, or restaurant — can request deletion of their account and personal information at any time, regardless of where you live. To request deletion:

We'll verify your identity using your account information and delete your account and personal data within 45 days, except for records we're required to keep — for example, order history needed for a pending delivery, or financial records kept for tax, fraud-prevention, or dispute purposes. Where we retain anything after a deletion request, it's kept only as long as legally required and isn't used for anything else.

Your California privacy rights (CCPA/CPRA)

If you're a California resident, you have the right to:

To exercise any of these rights, use the same Support or email contact above. An authorized agent may submit a request on your behalf with your written permission.
